What Justices Barrett and Kagan Revealed About Threats Against Supreme Court Judges
Barrett delivered an unusually personal plea, recalling two specific incidents: a swatting attack on her home and the moment court security issued her a bulletproof vest when threats against her were particularly intense.
Barrett testified about the swatting directly: “My teenage son opened the door to go out with friends and saw our street full of police cars, who had responded to a false report of gunshots.” Her own security detail was the only reason police did not attempt to enter the home.
Kagan warned that “threats have come very close” for some members of the court, pointing to Trump’s personal attacks calling some justices “weak, stupid, and bad” and “fools and lapdogs.”
Kagan drew a clear line, saying: “Criticism is fair game. But intimidation is a different thing entirely. When political figures of any stripe are trying to intimidate judges, that’s where we really have crossed the line.”
What is missing from most coverage of this story is the bigger picture. Barrett is a Trump appointee. Kagan is an Obama appointee. These are two justices on opposite ends of the ideological spectrum sitting side by side and telling the same story about fear. That alone should stop people in their tracks.
Threats are coming from both sides of the political aisle. Kagan cited Chuck Schumer‘s 2020 comments warning Justices Gorsuch and Kavanaugh that they “will pay the price,” and Trump’s own attacks on Barrett and Gorsuch calling them “an embarrassment to their families” after the tariff ruling.
Barrett also warned that cybersecurity attacks on the court have risen “by magnitudes year after year,” with AI now making those attacks increasingly sophisticated and harder to stop.
